Please read carefully the following terms and conditions which you MUST obide by to use our products on your website or Cubecart installation. Your purchase or use of our products implies that you have read and accepted these terms and conditions.

Site Smart Web Services and Matthew Dunne are NOT affiliated with CubeCart or Devellion Limited in any way.

Product Licences

Site Smart Web Services grants you non-exclusive limited useage of our skins, templates, mods or other products on a single website or Cubecart installation to your own site or your clients site.  We retain full ownership of each skin template, mod or other product on this store,  when you purchase a product you are purchasing a licence to use that product, not ownership.

Site Smart Web Services provides its customers with 3rd party mods, skins, templates and other products and is no way affiliated with Cubecart. Cubecart is a trademark of Devellion Ltd.

We reserve the right to refuse any order which we deem to possibly be fraudulent. To ensure your order is not refused please ensure that you provide true and accurate information when registering on our store or making a purchase.

Assignability

You may use each individual product on a single website only, belonging to either you or your client. You have to purchase the same product again in order to install on another Cubecart installation or site. By agreeing to our terms and conditions before purchase and before installation you understand that we retain the right to restrict purchases to a single website domain or IP. address.

Images, Clipart And Fonts Used In Our Designs

All images, clipart and fonts used in our templates are royalty-free and are the integral part of our products. Limited-usage license gives you the right to use images, clipart and fonts only as a part of the website you build using your skin. You can use images clipart and fonts to develop one project only. Any kind of separate usage or distribution is prohibited.

Product Modifications

You are authorized to make any necessary modification(s) to our products to fit your purpose. Where it indicates that the template elements are fixed width or optimized then we cannot guarantee the products usability beyond these points.  You are NOT authorised to remove our Advertising Linkage from the bottom of any of our products without first purchasing the Removal service.

Where you commission custom work from me you will need to pay for 40% upfront before the work is carried out.  This is non-negotiable.

Assignability

You may NOT sub-license, assign, or transfer this license to anyone else without prior written consent from Site Smart Web Services such assignability requires the purchase cost to be made via a “unique price” which Site Smart Web Services will set before transfer.

Product Installations

Site Smart Web Services will NOT install a product for free unless its been pre-arranged with a customer as part of a package deal or custom design service.  Any installation work needed by a customer once the product is purchased must be bought seperately as an additional service.

Unauthorised Distribution

You may NOT place any of our products, modified or unmodified, on a diskette, cd, website or any other medium and offer them for re-distribution or resale of any kind without prior written consent from Site Smart Web Services.  If we find out, we will either contact your host, ISP or take legal action against you.

Product Ownership

All Site Smart Web Services advertising links MUST remain visible on all websites at all times. Removal of our advertising link shall signify explicit breach of our terms and conditions to which you agreed thereon. By agreeing to these terms and conditions you agree that you shall not remove or change any advertising linkage such as back-links that show our company name at the bottom of the designs.  This also includes obscuring the colour of the text in the advertising link so that it does not show at the bottom of the skin template.

Unless otherwise indicated, cubecart source code is not open source and is protected under applicable copyrights, trademarks and other proprietary (including, but not limited to, intellectual property) rights and are the property of Devellion or the material is included with the permission of the rights owner and is protected pursuant to copyright and trademark laws. All rights reserved.

Your use of skin templates and all images signifies your unconditional and irrevocable acceptance of these conditions and the published terms and conditions.

In addition to the price of the product purchase, a advertising linkage removal fee may be purchased upon checkout.

The customer must NOT recreate any of the design concepts for re-distribution or sale, that includes page layouts, colour shemes.

Our products are provided “as is” without warranty of any kind. In no event will Site Smart Web Services be liable to any party including the customer for any indirect, incidental or consequential damage in connection with or arising out of this Agreement (including for loss of profits, use, data, serve interruptions caused by any circumstances beyond our reasonable control).

You may NOT claim Intellectual or exclusive ownership to any of our products, modified or unmodified. All skin templates and/or products are property of Site Smart Web Services.

All our products no matter if they are of fixed price or free are still the property of Site Smart Web Services, you are simply purchasing a licence to use the product on a single store/website for your own use.

Refund Or Exchange Policy

Since Site Smart Web Services are offering a non-tangible irrevocable goods we do not issue refunds after the products is shipped, which you are responsible for understanding upon purchasing any product at our site.

We also do NOT make exchanges of products if you have purchased the product by mistake because you did not read the description properly. We have no way of checking that you have destroyed the product purchased by mistake or that you will not use it at a later stage on another installation.

We only make exceptions to this rule if the product has not been shipped to a customer on a case by case basis in agreement of the parties concerned.

Chargeback Policy

In the event that any customer issues a chargeback request they will be immediately and permanently banned from making any future purchases from this store. There should never be any reason to request a chargeback, if you have not received your purchase after 24 hours contact Site Smart Web Services and i will assist you.

If you issue a chargeback all other Commercial 3rd party designers and contributors will be notified of this including all your purchase details, IP address, Paypal address and other information for security reasons to inform them of your deliberate fraudulent activity.  This will mean you will not be able to purchase another product from their store either so think twice.  Our store is connected to all other 3rd Party designer and contributors stores via full automation so if you committ fraud on another 3rd party commerical website we will also be notified.

If you are having problems with either installation or with your template / website design, we can provide full assistance to rectify any problems that may arrise, you simply have to ask.  This does not include custom codework, just the base code distributed in the original skin template.  If you require custom codework to be done, a fee will be charged accordingly.

Anti-Fraud Checking

All customer orders will be checked manually by our antifraud protection system which could take up to 24 hours before we will issue a product to a customer.  We will check the background of your store as well as your registration details and order details to make sure its 100% accurate before sending out any products.  We will also only send out the product to a registered Paypal email address where we received the payment from.

Antifraud check occurs because of growing number of fraud transactions from persons who are not actual cardholders of the credit cards used during purchases. Because your payment safety is important to us it may take up to 24 hours for your purchase to become available for download.

Site Smart Web Services reserves the right to change or modify these terms and conditions with no prior notice.
